The North Face®, a division of VF International Sagl (“The North Face”) is offering the THE NORTH FACE Pro-Programme through its website. The Programme is subject to the following Programme Terms and Conditions (these “Terms”).
By registering to become a member of the Programme and by accessing, using or participating in the Programme, you (i) represent that you are 18 years of age or older and (ii) agree to the Terms.
To join the Programme, you must be part of one of the categories of industry professionals that THE NORTH FACE supports in our Programme. Membership to the Programme must be renewed on a yearly basis.
Applications to The Programme are assessed on an individual basis, and membership granted at our discretion following the evaluation of the qualifying criteria listed below. The qualifying details below are issued as guidance only, and the list of criteria categories is not exhaustive, and The North Face reserves the right to possibly consider additional applications related to this list may be considered.
By applying to this Programme, we ask that you abide by the rules of the Programme. By completing the application, you acknowledge and agree to abide by the responsibilities described in the terms and conditions below.
Please read all the information below before applying for the Programme including Terms of Use and Privacy Policy below. To be approved, you must take all of the required steps and provide the required documentation as follows.
QUALYFING CRITERIA AND APPROVAL PROCEDURE
To apply to the Programme, you must provide your personal or work email address your name associated to the eligibility determined through proof of active employment/engagement for the following employment categories:
OUTDOOR INDUSTRY: Full-time employees of outdoor brands, suppliers and distributors whose employers are members of organisations including, but not limited to, ISPO, EuroBike, or EFTTA and offer a reciprocal deal to TNF/VF employees.
MOUNTAIN GUIDES: Affiliated mountaineering and climbing guides with recognised certification from a national or regional body working full-time for a recognised outdoor operation.
SNOWSPORTS INSTRUCTOR: Ski/Snowsports instructors who are certified by their national agency and actively instructing multiple days per week during the operational season.
SEARCH AND RESCUE (SAR): Active members of search and rescue agencies with demonstrable proof of membership and participation in search and rescue activities.
SKI PATROL/SNOW SAFETY: Ski patrollers and avalanche/snow safety experts working full-time at ski resorts.
BACKCOUNTRY/MOUNTAIN HIKING/TRAIL RUNNING GUIDES & INSTRUCTORS: Full-time guides working for recognised backcountry/hiking operators.
MOUNTAIN RESORT EMPLOYEE: Full-time employees of mountain resort working in corporate management or on dirt/snow. Applications from employees involved in food service, day care or similar will not be accepted.
CLIMBING GYM EMPLOYEES: Full-time employees of climbing gyms.
OUTDOOR MEDIA/PROFESSIONAL PHOTOGRAPHER: Full-time employees at established outdoor-focused publications and media outlets including but not limited to photographers, videographers. Primary occupation must be in the outdoors.
ENVIRONMENTAL NGO: Full-time employees at NGOs working in the outdoor sector to protect and manage the environment. Including but not limited to cycling and outdoor advocates, field biologists, field/steam restoration workers. Applications from volunteers will not be accepted.
WHAT TO EXPECT IN THE APPLICATION PROCESS:
Please remember to send in the proper documentation to support your application in a timely manner. If you have a question about your application, feel free to email tnfeuropepro@ipa-connect.com. Once you submit the required documentation and information, you will receive confirmation of acceptance or rejection of your application within 2 (two) days.
WHAT COULD KEEP AN APPLICATION FROM BEING APPROVED
1. Please submit required documentation. If we do not receive the proper credentials to support your application, you will not be approved.
2. Remember to use your business email, if applicable.
THINGS TO KNOW ABOUT THE PROGRAMME – GENERAL TERMS
1) Membership to Programme should considered as privilege, rather a right or entitlement. It is not a partnership between The North Face and Pro Programme Members.
2) The Programme membership is for personal use only. Products purchased using your Programme membership discount are designated for personal use.
3) Resale and/or Gifting is prohibited. Unless stated otherwise, the purchase of gifts or resale activity through Programme discounts will result in the termination of your Programme membership.
4) Membership to Programme is non-transferrable, and discount use is limited to the individual approved member. In the event of a dispute over ownership of a membership, the registration will be declared to have been made by the authorized account holder of the email address submitted at the time of registration as determined by The North Face. For purposes of these Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
5) The Programme membership entitles you to a maximum of 3000 EUR (or local currency equivalent) spending limit during your 12-month membership period. The North Face reserves the right to track of each individual member’s purchases.
6) The North Face reserves the right to change Programme membership Terms and Conditions at any time. If The North Face changes or modifies these Terms, it will provide notice of any changes through these Terms. Electing to remain a member after a change in the Terms constitutes your acceptance of the revised Terms. The revisions to the Programme that The North Face may make include, but are not limited to, any of the following changes: (i) cease providing a Benefit; (ii) the revision of eligibility criteria, (iii) spending limits, (iv) the operation and application of Programme discounts.
7) The discount and benefits of Pro Programme membership to be kept discreet. Non-eligible, non-member Parties interesting in The North Face should be referred to The North Face Stores and Website. Parties eligible for The North Face Pro Programme membership may be referred to the Pro Programme application page to submit a personal application.
8) Abuse of the Programme, including failure to abide by these Terms, and failure to abide by The North Face website Terms of Use, which are incorporated herein by this reference, the sale or barter (or the attempted sale or barter) of Benefits, or promotional offers, excessive returns of Qualifying Purchases, fraud or tampering with any Benefit, including any survey or poll or sweepstakes entry, and any misrepresentation of fact relating thereto or other improper conduct as determined by The North Face in its sole judgment may result in cancellation of a Member's membership and future disqualification from Programme participation, and cancellation of previously issued but unused Benefits. At our discretion we may prosecute abuse of the Programme to the fullest extent of the law.
9) You agree that participation in the Programme, membership in the programme, and use of any products or services related to the Programme, including all benefits in connection with the programme, is entirely at your own risk.
10) You may cancel your Programme membership at any time by writing to Customer Service at Contact Us. Cancelling your Programme membership you will also delete your Programme account. The North Face store associates are not able to resolve issues with membership.
11) The North Face is not responsible for events outside its control. If the provision of the programme is affected by an event outside its control, then The North Face will notify members as soon as possible to let them know and will take reasonable steps to minimize the effect of the event on the Programme. To the fullest extent permitted by law, The North Face disclaims any warranties for viruses or other harmful components in connection with the Programme, The North Face websites, and app. Some jurisdictions do not allow the disclaimer of implied warranties. In the United Kingdom, the foregoing disclaimers will not apply to you.
12) The North Face is responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaching these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the terms were agreed, both we and you knew it might happen.
13) The North Face shall not be liable for damages resulting from your misuse of the The North Face websites, the app from your inability to use the The North Face websites, the app or from interruption, suspension, and alteration of the The North Face websites, the app due to reasons beyond the control of vf, except where such loss is caused by the negligence of The North Face, its agents or distributors or that of their employees. Your statutory rights are not affected, and these limitations shall apply to the fullest extent permitted by law. In addition, certain other jurisdictions do not permit limitations of liability. In such jurisdictions, some of the foregoing limitations may not apply to you.
14) You agree to hold The North Face, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, vendors, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of your submissions.
15) To the fullest extent permitted by law, the Programme and these Terms and any claim or dispute arising out of or relating to the same, or your use of The North Face Websites or the App will be governed by and construed under the substantive laws of Switzerland, without reference to conflict-of-laws considerations.
16) If any provision of these Terms is held to be unlawful, or for any reason, unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
17) If a dispute arises, we strongly encourage you to first contact our Customer Service Department before starting a judicial proceeding. We value our relationships with our customers and will try to resolve your claims informally and quickly.
HOW TO MAKE A PURCHASE AS A MEMBER OF THE PROGRAMME
As a member of the Programme, you are entitled to a discount reserved for you when you make your purchases that will be communicated to you in the Welcome email. Please note that the Programme membership entitles you to receive periodical discounts during your 12 month membership period.
The first discounts offered as a member of Programme will be communicated to you in the Welcome email that you will receive upon membership (re)confirmation within 7 days.
Please note that some items might be excluded from your discount allowance including, but not limited to, Men’s and Women’s 1996 Retro Nuptse Jacket.
The North Face reserves the right to add or remove products from the Programme product selection at its discretion. The excluded products will be listed within the email you received along with the promocodes to be used. Programme discount cannot be applied retrospectively.
Access your Programme discount online only. Any order returns must be returned online and can be managed on our Returns page.
Orders placed through the Pro Programme are subject to the general terms and conditions applicable of The North Face., you will receive service emails regarding the Programme. These may include information about your enrolment to the Programme and the related Benefits, such as discounts and promocodes. If you want to stop receiving all the communications, this will cause your early cancellation from the Programme. Should you then wish to cancel your account you can contact Customer Service via our Contact Us.
Please note that cancellation to the Programme does not imply the unsubscription from the marketing newsletter. Should you wish to stop receiving marketing emails, you may follow the process outlined in section C below.
In addition, if you have expressly given your consent to receive profile-based marketing communications, you will receive emails regarding promotions, events, and other promotional activities. If you want to unsubscribe from The North Face promotional emails, you can do it at any you can click on the unsubscribe link in the marketing emails you received, contact customer service or write an email to privacy_europe@vfc.com. DATA PROCESSING, MARKETING AND PROFILING
By registering, you acknowledge to have read and understood Privacy Policy regarding the collection, use and disclosure of your personal information in the context of the Programme.
The processing of any personal data of participants, is necessary to enable the participation to Programme and will be carried out by The North Face and IPA CONNECT, LLC (“IPA”) in its capacity as independent Data Controllers.
Personal data will be processed in compliance with the current laws and regulations applicable to the processing of personal data, including the EU General Data Protection Regulation N. 679/2016 (GDPR) and retained for the time necessary to fulfil the data processing purposes herein described, except when longer or shorter retention periods are provided for by law.
Please note that your data will be processed:
a) for the evaluation of your application to the Programme data will be processed by IPA. IPA will process your personal data in accordance with General Data Protection Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") as well as applicable local data protection laws, the orders and guidelines issues by the competent data protection authorities (the "Data Protection Laws"). b) For the management of your subscription to the Programme, data will be processed by The North Face in accordance with applicable Data Protection Laws.
